This Agreement contains the entire understanding between Kaley Hayward Photography ("Photographer") and the above named Client ("Client") for the purpose of a Photography Session. Please review and complete the following: *

Yes, I agree

RESCHEDULING: In the event that the Client needs to reschedule a session, notice must be given at least 24 hours prior to the scheduled time and must be rescheduled within one year. Photographer will make the judgement call to reschedule in the event of inclement weather. Sessions will not be rescheduled due to cloudy weather. *

LIMITS OF LIABILITY: Kaley Hayward Photography takes the utmost care with respect to the exposure, development and delivery of all photographs. However, in the event that Kaley Hayward Photography fails to comply with the terms of this Agreement due to any event or act which prevents the delivery of the work from the Assignment, Kaley Hayward Photography’s liability to The Client shall be limited solely to a refund of all money paid by The Client to Kaley Hayward Photography, and The Client’s sole remedy shall be receiving a refund of all money paid by The Client to Kaley Hayward Photography. *

COPYRIGHT: The work created by Kaley Hayward Photography during the session constitutes the copyrighted work of the Photographer and Kaley Hayward Photography. The work at all times shall remain the property of the Photographer and Kaley Hayward Photography. Any portion of the work delivered to The Client is for personal use only. The Client may not sell nor authorize the sale of any portion of the work without Kaley Hayward Photography’s written consent. *

MODEL RELEASE: The Client shall permit Kaley Hayward Photography to use images of The Client from any portion of the session for display, publication, or other promotional uses without payment or additional compensation to The Client. *

DANGEROUS CONDITIONS: If, during the session, the Photographer is exposed to: (a) conditions which imperil or cause the Photographer to fear for their safety, or (b) objectionable or illegal acts to which the Photographer does not wish to be a party or witness, then Kaley Hayward Photography reserves the right to immediately protect Kaley Hayward Photography and the Photographer’s interests, including but not limited to cessation of the Assignment, leaving the Assignment location(s), and/or terminating this Agreement. In such circumstances, Kaley Hayward Photography will not refund any moneys paid by The Client. *

DELIVERY: At the conclusion of the session Kaley Hayward Photography will retain the images for processing. The Client’s images will be available 2-6 weeks after the session date. The images released to The Client are the only images available for viewing, purchase and release. *

COVID-19: Client and Subjects agree to abide by public health restrictions related to COVID-19 at the time of the Event. *

This Agreement incorporates the entire understanding between Kaley Hayward Photography and the Client. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the Province of Alberta. *
